no, because you will notice that your water heater should have a recommended setting as well as a warning on it about setting it too high. that's CYA. You will probably also find CYA language in the owner's manual for your oven. Since it is you who heats water in a kettle above a safe temperature (still you will probably find CYA language in the owner's manual for the kettle), it is YOU who are liable. It's ALL legal mumbo jumbo but it's meant to shift responsibility from the manufacturer to the user. That is the difference here. McDonald's themselves exceeded the safety range on their product. Not the purchaser. I have even started seeing CYA language in restaraunts stating that they are not responsible for food that is ordered at a less than completely cooked state (rare, medium rare, etc.). Is it legalism run rampant? Yeah. But is it necessary? Yeah, I think so. But then, I think man is inherently evil.
